PRIVACY STATEMENT

PURSUANT TO ART. 13 OF THE REGULATION (EU) 2016/679 (GDPR)

In accordance with Regulation (EU) 2016/679 (GDPR) and subsequent additions and modifications, we provide you with the necessary information regarding the processing of all personal data provided by you. This privacy information is provided pursuant to art. 13 of Regulation (EU) 2016/679 (GDPR).

  1. DATA CONTROLLER

The Controller is Gusto Artigiano Srls, with registered office in Via Ivrea 28, 00183, Rome (RM) , Vat number 13997011005, in the person of its pro tempore legal representative. Email: privacy@italiadelight.it.

  1. TYPES OF PERSONAL DATA

Article 4 of Regulation (EU) 2016/679 (GDPR) defines “personal data” as: “any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified,  directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.

“Processing” means: “any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction”.

  1. PURPOSE OF THE DATA PROCESSING

The personal data that you provide will be processed, in accordance with the conditions of lawfulness referred to in art. 6 of Regulation (EU) 2016/679 (GDPR), for purposes concerning the performance of the contract and the compliance with a legal obligation, for administrative or accounting purposes (article 6, paragraph 1, letter b).

  1. a) In particular, the data subject’s consent is strictly necessary for the registration on italiadelight.it and for the use of Italia Delight services, with particular reference to the Marketplace service.

By accepting this privacy statement, you give your consent to the processing of personal data for the registration on italiadelight.it, in addition to those added with the aim of providing more information or illustrations related to your activities for purposes related to the services provided by Italia Delight, as well as to the communication of your personal data to the users registered on italiadelight.it and authorised to operate for a prior evaluation of Users. In particular, personal data are collected and processed in accordance with Regulation (EU) 2016/679 (GDPR) and Decreto Legislativo n. 196 of 2003 in paper form, IT, telematics for contractual and legal requirements and for any operational, management, study and research need for the development of the activities carried out by Gusto Artigiano Srls.

  1. b) Personal data are also processed for the following purposes, with respect to which your consent is optional:

_ statistical research and market analysis with exclusive advantage of business operators of other sectors (as an example, which is not exhaustive, showrooms, advertising agencies, carriers, insurance companies, banks, accessories, etc.) in order to allow the promotion of other products and/or services;

_ sending information about Italia Delight services by email;

_ sending news about Italia Delight by email;

_ sending information and advertising material by email;

_ sending information, monitoring and evaluation of the subjects in charge of the control of Gusto Artigiano Srls;

_ dissemination of interactive commercial information.

  1. RECIPIENTS OR CATEGORIES OF RECIPIENTS

Personal data may be disclosed to recipients belonging to the following categories:

_ third parties and consultants on tax matters;

_ the Revenue Agency;

_ social security institutions and financial administration, in order to fulfil any social security, welfare, insurance and tax obligations;

_ subjects within Italia Delight, who receive instructions on the processing from the Controller;

_ external subjects that manage, support and assist, even occasionally, the Controller in the administration of the information system and telecommunication networks (including e-mail);

_ authorities which are competent for the fulfilment of legal obligations and/or of provisions dictated by public bodies.

  1. PERSONAL DATA TRANSFER TO A THIRD COUNTRY AND/OR AN INTERNATIONAL ORGANISATION

The personal data that you provide are not transferred abroad within or outside the European Union.

  1. PERIOD OF STORAGE AND CRITERIA

The processing will be carried out in an automated and/or manual way, with methods and instruments aimed at guaranteeing maximum security and confidentiality, by persons specifically appointed to do so. The personal data may be processed at operational headquarters of Gusto Artigiano Srls that are different from the registered office.

In accordance with the provisions of art. 5, paragraph 1, lett. e) of Regulation (EU) 2016/679 (GDPR), the personal data will be stored in a form that allows identification of data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed. The storage of personal data is determined on the basis of current legislation regarding the conservation of accounting records and, specifically, they have currently been stored for 10 years.

  1. NATURE OF CONSENT AND REFUSAL

The processing of personal data for the purposes referred to in point 3, letter a), is a necessary requirement for implementing the contractual relationship and for the use of Italia Delight services. Therefore, failure to confer personal data make it impossible to register on the website and use Italia Delight services.

Consent for the purposes referred to in point 3, letter b) is optional.

  1. RIGHTS OF THE DATA SUBJECT

You will be able to exercise your rights, as stated in articles 15, 16, 17, 18, 19, 20, 21, and 22 of Regulation (EU) 2016/679 (GDPR), by contacting the Controller.

You have the right, at any time, to ask the Controller at the email address privacy@italiadelight.it access to your personal data, rectification, erasure, restriction of processing. Furthermore, you have the right to object, at any time, to the processing of any personal data relating to your particular situation (including automated processing, e.g. profiling ) and the right to data portability. Without prejudice to any other administrative and judicial appeal, if you consider that the processing of your personal data is in breach of the provisions of Regulation (EU) 2016/679 (GDPR), pursuant to art. 15 , paragraph 1, letter f) of the aforementioned Regulation, you have the right to lodge a complaint with a supervisory authority and, with reference to art. 6 , paragraph 1, letter a) and art. 9, paragraph 2, letter a), you have the right to withdraw your consent at any time. In exercising your right to data portability, the Controller will provide you with your personal data, in a structured, commonly used and machine-readble format, without prejudice to paragraphs 3 and 4 of the art. 20 of Regulation (EU) 2016/679 (GDPR).
